Driving Under the Influence (DUI) Manslaughter Defense Attorney

According to Florida Statute 316.193(1) and 316.193(3)(c)(3) a DUI Manslaughter crime is defined as any person who drives a vehicle, or found to be in control of a vehicle, within the state of Florida while under the influence of alcohol, chemical, or controlled substances and causes the death of another person either directly or indirectly

Penalties

The crime of DUI Manslaughter is a second-degree felony and a Level 8 offense severity under Florida’s Criminal Punishment Code.

Punishable by:

  • up to fifteen years in prison (mandatory minimum of 4 years);
  • up to fifteen years probation;
  • a $10,000 fine;
  • permanent driver’s license revocation;
  • impoundment of driver’s vehicle; and
  • successful completion of DUI Substance Abuse course, Community service, and psychological and substance abuse evaluations.

Possible Defenses

DUI Manslaughter may be combated with several defenses that include challenging the officer’s procedures and lack of evidence. It is always important to know your rights, as well as know when to be silent. Sercombe Law is on your side and could help you enter a DUI Expungement in the statement of Florida.

Orlando Attorney Handling DUIs and Other Criminal Matters

Police officers in Orlando are very aggressive. For example, if you are pulled over for a DUI, an arrest is pretty much inevitable, even if you “pass” the Breathalyzer test. Or, if police respond to a domestic violence call, someone will go to jail that night.

Prosecutors are very aggressive as well. Everyone wants to move up the corporate ladder. And, for Assistant State Attorneys, the number of convictions is about the only way to move up. Furthermore, to maintain good relations with law enforcement, prosecutors rarely decline to file charges.

In other words, if you aren’t part of the criminal justice system, the deck is stacked against you. You need an aggressive attorney to level the playing field.

A dedicated lawyer greatly increases the chances of a successful outcome. For a free consultation with an experienced criminal defense attorney in Orlando, contact Sercombe Law.
