According to Florida Statute 316.193 a Felony DUI crime can be committed through a number of unfortunate avenues, including:

  • DUI resulting in serious bodily injury;
  • A DUI following status as a Florida Habitual Traffic Offender or a Violent Felon offender; or
  • Repeat offenders are subject to felony DUI charges if convicted of a third DUI offense within 10 years.

DUI Manslaughter is also a Felony DUI. When a DUI results in a death, the prosecutors can charge the crime of DUI manslaughter or Vehicular Homicide. It is a second-degree felony punishable by up to 15-years in prison and a fine of not more than $10,000. DUI Manslaughter can be elevated to a first-degree felony (30 years prison and $10,000) when the defendant leaves the scene of the crime without rendering aid or giving information.

Penalties

The crime of Felony DUI is a third-degree felony.

Punishable by:

  • up to five years in prison;
  • up to five years probation; and
  • a $5,000 fine.
